1. Acceptance of Terms
These Terms of Use ("Terms" or "Agreement") constitute a legally binding agreement between you (whether as a consumer searching for services, or as a business/contractor listing your enterprise) and Directory Hub ("Portal", "we", "us", or "our").
By accessing, using, searching, or interacting with Directory Hub, you unconditionally accept and agree to abide by these Terms, as well as our Privacy Policy. If you do not agree to any provision of these Terms, you must immediately cease accessing or using our services.
2. Nature of Platform (Intermediary Status)
Directory Hub operates strictly as an intermediary search platform under Section 79 of the Information Technology Act, 2000. Our platform provides discovery, directory listings, contact details, and quote routing for local businesses, contractors, service specialists, and tradespeople.
No Agency or Employment: Directory Hub is not an employer, contractor, broker, or agent for any listed business. Any contract, transaction, payment, or service agreement is executed solely between the consumer and the independent business or contractor.
3. User Obligations & Enquiry Guidelines
When using the Portal or submitting inquiries to listed businesses, you agree that you shall NOT:
- Submit fake, fraudulent, or malicious quote requests or telephone numbers.
- Use automated bots, web scrapers, spiders, or extraction scripts to harvest business listings or contact data.
- Harass, abuse, defame, or intimidate any listed business owner or contractor.
- Post false or slanderous reviews or ratings intended to extort or unfairly damage a business reputation.
- Violate any local, state, national, or international law, including telecommunications and intellectual property laws.
4. Business Listings, KYC & Verification
For merchants, contractors, and business subscribers listing on Directory Hub:
- Accuracy of Information: You certify that all business names, contact persons, telephone numbers, addresses, license numbers, and credentials submitted are truthful and accurate.
- Mandatory KYC Documents: Directory Hub reserves the right to request proof of identity (PAN card, Aadhaar, GSTIN, Trade License, Shop Act registration) prior to or following publication.
- Subscribers Portal: Platinum and paid directory subscribers receive access to a dedicated client portal to manage portfolio photos, service catalogs, and customer leads.
- Right to Moderate: Directory Hub reserves the absolute discretion to reject, suspend, or delete any listing that violates community standards, provides deceptive information, or accumulates consumer fraud complaints.
5. Commercial Communications & Verification Calls
By providing your mobile telephone number on Directory Hub (either to register a listing or submit an enquiry), you expressly confirm:
- That you are the rightful owner or authorized user of the provided telephone number.
- That you authorize Directory Hub and its matched contractors/vendors to call, send SMS notifications, or deliver WhatsApp messages regarding your requested quotes and business inquiries.
- That this explicit consent overrides any registration on the National Do Not Call (NDNC) or TRAI National Customer Preference Register (NCPR / DND).
6. Intellectual Property Rights
The Directory Hub brand, portal design, compilation database, logos, styling, search algorithms, and software code are the exclusive intellectual property of the Portal and protected by copyright and trademark laws.
Listed businesses retain ownership of their respective registered trademarks, logos, and uploaded project photographs. By uploading media to Directory Hub, the business grants us a non-exclusive, royalty-free license to display such media on our search portal and marketing channels to promote their listing.
7. Disclaimer of Warranties & No Workmanship Guarantee
THE SERVICES AND DIRECTORY LISTINGS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
No Workmanship Warranty: Directory Hub does not warrant, verify the quality of, guarantee, or endorse the workmanship, safety, punctuality, pricing, or integrity of any contractor, artisan, professional, or merchant listed on the Portal. Users must conduct their own independent due diligence, inspect past work, verify licenses, and agree on written contracts before hiring any service provider.
8. Limitation of Liability
To the maximum extent permitted under applicable law, in no event shall Directory Hub, its founders, directors, employees, or affiliates be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of:
- Any service, transaction, defect, delay, or dispute between a user and a listed business.
- Inaccurate, incomplete, or misleading business listings posted on the platform.
- Temporary downtime, technical errors, server maintenance, or communication failures.
9. Moderation, Suspension & Termination
Directory Hub reserves the right to immediately suspend, deactivate, or delete any listing or user account, without refund, in the event of:
- Breach of these Terms of Use or our Privacy Policy.
- Submission of fabricated KYC documents or stolen credentials.
- Multiple verified consumer grievances regarding fraudulent business conduct or non-performance.
10. Governing Law & Dispute Resolution
These Terms shall be governed by, construed, and interpreted in accordance with the laws of the Republic of India. Any legal dispute, proceeding, or claim arising out of or relating to these Terms or Directory Hub services shall be subject to the exclusive jurisdiction of the competent courts located in Pune / Maharashtra, India.
